House completion in Whitechapel and Shoreditch happens in 30 days

In April 2008 Fridays Whitechapel and Shoreditch team acted on the purchase conveyancing for a freehold property valued at around £525, 000. The property is located in Stepney, London.

Fridaysmove completed this conveyancing matter in under 30 days of receiving the sale documentation from the registered proprietors conveyancing solicitor. Fridaysmove Legal property lawyer s ensured that the enquires were served within 2 days of receiving the relevant documentation.

The Land Registry Office Copies supplied were out of date and accordingly fresh copies were requested from the registered proprietors conveyancing solicitor.

The Land Registry Office Copies supplied revealed that the registered proprietors had owned the property for less than five years and as such there was a danger that the transfer of the property to the seller could be set aside if it was established that the property within that five year period was a Transfer at Undervalue.

Transfer at Undervalue:The estate agent's particulars of sale detailing the registered owners conveyancing specialist was obtained shortly before receiving the conveyancing agreement. This document outlines the sale/purchase property, the price, the Purchaser and the Seller’s details and details of their respective conveyancing teams. It is worth noting that a Sales Memorandum  does nothing more than record the agreement reached between the parties subject to contract and forms no part of a contract for the sale of the said property between the parties

A right of way was revealed in the Office Copies supplied by the Land Registry. Our conveyancing lawyer ensured that the right of way was used without interruption and without causing a nuisance to the registered proprietors. The Land Registry documentation revealed that the property was subject to restrictions/rights/covenants as set out in a conveyance dated 22/07/1984. It was important that we check with the registered proprietors conveyancing solicitor that the aforementioned restrictions/covenants etc. had been fully complied with.   A right of way is a right which gives a person access across certain property . (Usually land owned by someone else)

The Seller's Property Information Form (SPIF) as supplied by the registered proprietors was more than two months old and therefore we needed to have this refreshed. The sellers property information form is part of the Law Society's National Conveyancing Protocol to be completed by a seller in a conveyancing transaction. It is not a compulsory document for a HIP. The sellers property information form gives details about the property  such as neighbour disputes and boundaries and the answers therein are legally binding on the seller.
