Risk of natural subsidence uncovered by conveyancing searches

Our property conveyancing Walton On Thames team, in April 2008, handled the purchase conveyancing for a freehold, for a residential dwelling valued at around £387, 500. 00.  This particular property was located at Walton On Thames in Surrey and this meant that the local authority area of the home was Elmbridge Council.

Within the same day of receiving purchase agreement, the conveyancing inquiries were issued.  The handling conveyancer discovered that there were also planning permissions affecting this residence.

The conveyancing searches revealed that the property was at risk of natural flooding (as shown on area environmental searches).  We needed to check with the owners whether or not the property had ever suffered from flooding, as well as make sure that the insurance would be available to cover the risk of flooding.  A risk of natural subsidence was uncovered – further details of which can be viewed in the environmental searches.  A right of way was also revealed in the Office Copies, supplied by the Land Registry.

The Land Registry documentation revealed that the property was subject to restrictions/rights/covenants as set out in a conveyance dated 17/08/1953.  It was important that we checked with the owners property solicitor that these restrictions had been fully complied with.
