In the conveyancing process, encroachment refers to a situation where a boundary has gradually encroached to a neighbouring property or an area of land that is excluded from the property’s legal boundaries.  

If a buyer or a seller suspects that this has occurred, they should notify their solicitor as soon as possible so that this problem can be resolved as early as possible. The conveyancing procedure is likely to be delayed if a solicitor finds any evidence of encroachment.
