Conveyancing process reviewed by Law Society

The Law Society ( which is the regulatory body for conveyancing solicitors in England and Wales )  is about to conduct  a detailed consultation into the conveyancing process.

The intention, as far as can be ascertained, is to consider ways to improve the conveyancing process to benefit consumers. The consultation paper, Improving Residential Conveyancing: A consultation by the law" target="_blank">Law Society, seeks practitioners' views on a revised conveyancing protocol and forms, an electronic conveyancing portal and a voluntary "TransAction Plus" membership scheme.

The Residential Conveyancing consultation makes clear, residential conveyancing solicitors face a difficult property  market. These economic difficulties combined with the pending emergence of  new entrants into the conveyancing market ( sometimes termed “ Tesco Law “ ), ever demanding and complex anti-money laundering requirements and, the emergence to conveyancing brokers and new technology, have resulted in a changing landscape for conveyancing solicitors.

The consultation is looking  the views of  conveyancing solicitors ( as opposed to Licensed Conveyancing lawyers ) such as Fridaysmove   on how the conveyancing process might  be improved. Conveyancing solicitors of course have a central role in residential conveyancing. According to the Law Society conveyancing solicitors are in the best position to bring the necessary legal expertise to this complex process.

Paul Marsh, Law Society President, said: "It is essential to the security and smooth operational working of the home buying and selling process that solicitors remain at the heart of residential conveyancing. Building on the high standards of solicitors, embracing technology and moving ahead of the times will help to achieve that aim. The Law Society is considering some radical ideas which need to be faced head-on. Solicitors have demonstrated their versatility and commitment to change. It is important that we build upon the services provided by the profession in residential conveyancing, and challenge some basic assumptions, whilst continuing to ensure that consumers have access to the integrity and expertise that underpin the whole process. "
