Sale Conveyancing Explained – why adult occupiers need to sign a contract

The contract is probably the most important document in the conveyancing process, and will eventually legally commit you to the transaction.  

It is an important part of the sale conveyancing process that all registered proprietors of the property sign the contract before exchange of contracts can take place.   It is also a requirement that any remaining adults who also live at the property confirm that they will move out of the property on completion of the sale.

An adult occupier is anyone over the age of 17 years, (this is because they may become 18 years of age before completion takes place) and includes any children of the registered proprietors.   This is because they are deemed in law to have a right of occupation.   Any buyer for your property will want a guarantee that all adults will be moving out of the property on completion.  

The clause may be added to the end of the contract document itself or the occupier may be expected to enter into a supplemental agreement. Without signing, an occupier could be entitled to live at the property, even after completion has taken place. For more information about conveyancing please call us.
