Conveyancing in Bromley for the sale of a freehold dwelling on Moorside Road, Bromley, BR1 was handled by Solicitor Matthew Rumbold.
The vendors of the dwelling had acquired the property from the local council for Bromley borough in September of 2000. Contained in the transfer held by the land registry were the following restrictions that were imposed on the purchasers by the council:
- Property shall not be used for any purpose other than for residential purposes.
- No trade, business or manufacture of any kind whatever shall be carried on upon the property and any part of the property not built upon be used for the purpose of a private garden only except with the prior written consent of the council (such consent not to be unreasonably withheld) for other purposes specified in that consent.
- Not to cut down, remove, top lop or otherwise interfere with any ornamental or other trees or saplings now growing on the property except where in the opinion of the local authority the said trees interfere with the reasonable enjoyment of the property or any adjoining property or the said tree have become dangerous or are likely to cause damage to the dwelling or to any adjoining land.
- Nothing shall be done or allowed to be done on the land hereby transferred which shall be or may become in the opinion of the local authority a nuisance, damage or annoyance to the council or to the owners or occupiers of adjoining or neighbouring houses including any action which may contravene the race relations act 1976 or sex discrimination act 1975.
- Not to alter the appearance of the frontage or the roof line of the property not to erect or allow any erection to be placed on the front boundary of the dwelling so as to be at variance with the appearance of the neighbouring properties retained by the council without prior written consent (such consent not to be unreasonably withheld).
- The transferee hereby indemnifies the authority against any expenses incurred or demands made against the authority for the laying of any such pipes cables or other apparatus referred to above to the adjoining land or in respect of any works required to be done by the water gas or electricity undertakers as a result of this transfer.
It was important for Matthew to bring these provisions to the attention of the purchasers and their Conveyancing Solicitor as restrictions on ex-council dwellings require consent, in addition to the normal planning approval and building consent when submitting applications for renovations or works.
Thankfully, the above stipulations were not a major concern for the purchasers and the transaction completed within the scheduled time frame.
