Successful conveyancing despite Unadopted Road

Mr and Mrs D were haunted by the complications involved in purchasing a property on an unadopted road in October 2009.  They appointed specialist Conveyancing Solicitor in Horsham, Katie Clark to oversee their completion for a freehold property on The Pines in Horsham, valued at around £257,000. 

The property was in the local authority of Horsham District Council, and the local authority search revealed that The Pines was an unadopted road in this area.  An unadopted road, is one, that is privately owned and thus needs to be maintained privately, not by the council.  

is is of concern to Mortgage lenders and it was imperative for the Conveyancing Team in Horsham, to investigate who the road was owned by and who was responsible for the maintenance and upkeep of it.  The outcome was acceptable to the purchasers and the transaction could proceed. 

The Land Registry documentation revealed that the property was subject to restrictions/rights/covenants as set out in the transfer dated October 1976.  These were further investigated and found to be of no real concern to the purchaser.
