In May 2010, Fridaysmove -approved Solicitor Serina Abay was instructed to handle the Conveyancing in Poole for the sale of a freehold house located on Hasler Road, BH17 and valued at £165,000.

Serina’s clients had only owned the home since April 2005 and at the time of purchase, did not have detailed Conveyancing done by a Solicitor; therefore, they were unable to provide accurate information about previous flooding at the property and whether or not it was a listed building. No warranties were given in regards to the answers on the property information questionnaire and Serina recommended that the buyers and their Conveyancing Solicitor review this information by checking with the land registry office and local authority as any misleading or incorrect answers, if exposed later in the Conveyancing process, could endanger the sale.

The local authority district for the property is Poole Borough Council, Civic Centre, Poole, BH15 2RU.

The home is located within the boundaries of the safeguarding map for the local airport at Christchurch, BH23 6SE and the owner/operator of the airport would need to be consulted in regards to any developments carried out to the property if it exceeded 90 metres in height and was likely to attract birds and/or connected with an aviation use.

The following planning permissions were identified on the register of the search results:

  • 18589/10 - To erect 59 general needs houses WCH8 2.76 acres. CC. 15.07.75
  • 22475/0 - Erect garage. CC. 02.01.78
  • 18589/20 - That condition (ii) and (v) of the Planning Permission for the erection of 59 houses at the above site be relaxed (P. 18589/10). CC. 26.07.76

It was not compulsory for details and certificates to be provided to the purchasers as these permissions were over 30 years old, but Serina provided the planning permission grants for the above mentioned works to the buyers to avoid any potential issues/concerns.

Acting on behalf of the buyers was the Coles Miller Solicitors LLP branch at 44/46 Parkstone Road, Poole, Dorset, BH15 2PG.

As a purchaser, it is advised that your Conveyancing Solicitor check this documentation to ensure that any previous works were in full compliance with restrictions and conditions.

The grant for the erection of the garage stipulated that it is only to be used for purposes incidental to the domestic use as a single dwelling house and was not to be used for any trade, business or industrial use. This was to prevent detriment to the amenities of adjoining and nearby residents.

Contracts were exchanged on May 28th, 2010 and the transaction completed soon after on June 11th, 2010.
