Solicitor examines old title deeds for Conveyancing in Norwich transaction

Stephanie Gerstler, Norwich Conveyancing Solicitor, acted on behalf of Mr. and Mrs. H for the purchase of freehold abode on Nurseries Avenue, Norwich, Norfolk, NR13, with a price tag of £183, 000.

The land registry did not hold any records in relation to the property as registration in Norwich district did not become compulsory until 01/01/1974 and Stephanie therefore had to refer to the old title deeds to ensure that the property could now be registered under her clients’ names. This is common practice if the property has not changed hands within the last 30 years as registration was not common then. The deeds confirmed that the last Conveyance of the land was in 1966.

The following declaration was made by the sellers in property information questionnaire:

“I am assisting my mother to sell the house which she and my late father owned. I have never myself lived in it and my mother (now very elderly) was content to let my father deal with all matters relating to the property. Although answers are intended to reflect what is understood to be true, I cannot accept any responsibility for their accuracy. A purchaser should rely on the normal enquiries made by a solicitor during the sale process. ”

The local authority district for the property is Broadland Council at Thorpe Lodge, 1 Yarmouth Road, Thorpe St Andrew, Norwich, NR7 0DU.

A search of the local land charges register on 25 Nov 2009 revealed the following entries pertaining to the home and its’ surroundings:

  • Details: The property is within the Area of Special Control of Advertisements as defined by Norfolk County Council under Section 31 Agreement of Town and Country Planning Act 1947 and continued in force by Regulation 26 of Control of Advertisements) Regulations 1992 (Registration Date: 06 Apr 1992)
  • Details: Town and Country Planning Act 1990 - Tree Preservation Order ref Tree Preservation Order 1981 No 11 (393) dated 13 Aug 1981 - note: property might be affected by overhang only (Registration Date: 29 Sep 1981)

The seller’s Conveyancing Solicitor was the Birketts LLP office at Kingfisher House, 1 Gilders Way, Off Barrack Street, Norwich, Norfolk, NR3 1UB.

Sales documentation from the estate agent, Kudos Residential (155 Waterloo Road, Norwich, Norfolk NR3 3HY), with details from Birketts, were obtained shortly before receiving the purchase agreement.
