Purchase of leasehold property : Thames Road, Grays, Essex, RM17 - Conveyancing in Grays -

In October 2007 Friday's conveyancing Grays team were instructed to handle the purchase conveyancing for a 155 year leasehold for a property valued at around £160, 000. 00 located at Thames Road, Grays, Essex, RM17.

This leasehold property is in the local authority of Thurrock Council - www.thurrock.gov.uk/.

A risk of natural subsidence was uncovered - details were viewed in the environmental searches. This need to be further investigated.

The handling conveyancer discovered that there were Planning permissions affecting this residence.

The Land Registry Office Copies supplied revealed that the vendors had owned the property for less than five years and as such there was a danger that the transfer of the property to the seller could be set aside if it was established that the property within that five year period was a Transfer at Undervalue.

There was a concerning discrepancy between details of the vendors as per the sale and purchase agreement as against the Official Copies. This was obviously significantly important to clarify as our conveyancing lawyer needed to be sure that the registered owner and the seller on the contract were one and the same.

The Land Registry documentation revealed that the property was subject to restrictions/rights/covenants as set out in a conveyance dated 26th August 1897. It was important that we investigate with the vendors conveyancing solicitor that the aforementioned restrictions/covenants etc. had been fully complied with.
