In June 2009 our specialist conveyancing Esher and Claygate team previously acted on the purchase conveyancing for a freehold for a residential home valued at around £1,200,000.00 located
at Esher, KT10. The local authority area of the home is Elmbridge Council -
www.elmbridge.gov.uk/. Additional conveyancing questions were rendered within the
same day of receiving legal papers. The local authority search revealed that Park Close was an unadopted road in this area. This was of concern to the buyer and their mortgage lender.
Further investigations need to be made and with the vendors as to ownership of the road and practical arrangements in terms of maintenance and upkeep. A tree preservation order applied to
the property. The handling conveyancer discovered that there were Planning permissions affecting this residence. The Land Registry Office Copies supplied were out of date and accordingly
fresh copies were requested from the vendors conveyancing solicitor. The Land Registry Office Copies supplied revealed that the vendors had owned the property for less than five years and
as such there was a danger that the transfer of the property to the seller could be set aside if it was established that the property within that five year period was a Transfer at
Undervalue. The Land Registry documentation revealed that the property was subject to restrictions/rights/covenants as set out in a conveyance dated 25/03/1882. It was important that we
check with the vendors licensed conveyancer that the aforementioned restrictions/covenants etc. had been fully complied with. Gemma Farguson was the property lawyer in charge of
