A house-buyer in Halesowen was highly delighted that his purchase was completed in just 39 days. Catherine noted that there was a discrepancy between the names of the sellers as stated in the contract and the names registered with the land registry. This is not uncommon, and usually there is a straightforward explanation. Catherine pointed out the discrepancy to the sellers’ Solicitors, and they said that they would check with their clients. Having done so, they confirmed that the sellers were not married when they bought the house, but married afterwards. Therefore the lady had bought the house in her maiden name, but changed this when she got married. The solicitors provided a copy of the marriage certificate which Catherine could send to the land registry on completion as evidence of the change of name.
The land registry title stated that the house was subject to some restrictive covenants imposed in a 1978 Transfer, so Catherine asked the other Solicitors to supply a copy of this. When they did so, Catherine found that the restrictions were of the type commonly found on residential properties, and included such provisions as not using the property for commercial or business purposes, and not causing any nuisance to owners of adjoining properties. Restrictions of this nature are very common, and rarely cause any problems for buyers. Catherine asked for confirmation from the sellers that they had not done anything which might be a breach of the covenants, which they confirmed.
The local search did not show up anything unusual, and confirmed that the road adjoining the property was a public highway.
Once the search result was obtained Catherine was able to get her client to sign the contract. Both parties wanted a quick completion, and as soon as the buyer’s mortgage offer was received Catherine was able to exchange contracts and complete without delay. It took just 39 days from receipt of the draft contract to completion.
