In August 2007 Fridaysmove residential conveyancing West Sussex team were instructed to acton the purchase conveyancing for a freehold for a property valued at around £399,950.00 located at
Broad Street, Cuckfield, West Sussex, RH17. The local authority area of the property is Mid Sussex Council -
www.midsussex.gov.uk/. The handling conveyancer
discovered that there were Planning permissions affecting this residence. The conveyancing searches revealed that the property was at risk of natural flooding (as shown on area environmental
searches). We needed to check with the sellers whether or not the property had ever suffered from flooding as well as make sure that the insurance would be available to cover the risk of
flooding. The Land Registry Office Copies supplied revealed that the sellers had owned the property for less than five years and as such there was a danger that the transfer of the
property to the seller could be set aside if it was established that the property within that five year period was a Transfer at Undervalue. The Land Registry documentation revealed that
the property was subject to restrictions/rights/covenants as set out in a deed dated 13/06/1946. It was important that we check with the sellers conveyancing solicitor that the
aforementioned restrictions/covenants etc. had been fully complied with. Michelle Francis was the property lawyer in charge of conveyancing in West Sussex, South East England. The estate
agent's memo of sale detailing the sellers conveyancing solicitor was obtained shortly before receiving the letter with draft contract papers. The estate agent was the Mansell Mctaggart
branch covering West Sussex. -
