In February 2008, our conveyancing Hemel Hempstead team handled the purchase conveyancing for a freehold, for a home valued at around £390,000.00.  The property was located at Hemel Hempstead, Hertfordshire.

Additional conveyancing enquiries were served within the same day of receiving sale documentation (including documentation from the Land Registry).

A chance of shallow mining was revealed, by environmental searches, to possibly affect this residential area.

The handling conveyancer discovered that there were also planning permissions affecting this residence.

The Land Registry Office Copies supplied revealed that the registered proprietors had owned the property for less than five years and as such there was a danger that the transfer of the property to the seller could be set aside if it was established that the property within that five year period was a Transfer at Undervalue.

The Land Registry documentation revealed that the property was subject to restrictions/rights/covenants, that were set out in a conveyance dated 16th December 1964.

It was important that we checked with the registered proprietors conveyancing solicitor that these restrictions had been fully complied with.

Michelle Francis was the property lawyer in charge of conveyancing in the Hemel Hempstead area.
