Our conveyancing Windsor team, in September 2009, took instruction on the purchase conveyancing for a freehold for a home located at Eton Wick in Windsor.  The property was valued at around £320,000.00.  Windsor Council acted as the local authority on that particular area.

Additional conveyancing enquiries were served within the same day of receiving sale documentation, this included documentation from the Land Registry.  The Land Registry Office copies that were supplied, were out of date and so fresh copies were requested from the registered proprietors conveyancing solicitor.

These documents revealed that the registered proprietors had owned the property for less than five years and as such there was a danger that the transfer of the property to the seller could be set aside if it was established that the property within that five year period was a Transfer at Undervalue.

The Land Registry documentation revealed that the property was subject to restrictions, as set out in a conveyance dated 27th November 1959.  It was important that we checked with the registered proprietors conveyancing solicitor that these restrictions etc. had been fully complied with.
