The property was identified as a listed building. We needed to obtain a copy of the listings and insure that all previous works at the property complied with the appropriate listed building requirements and planning permissions.
Planning permissions were revealed to be in existence on the property and so investigated by our conveyancers in West Yorkshire.
The Land Registry Office copies that were supplied, were out of date and fresh copies were requested from the registered proprietors conveyancing solicitor. These copies revealed that the registered proprietors had owned the property for less than five years and as such there was a danger that the transfer of the property to the seller could be set aside if it was established that the property within that five year period was a Transfer at Undervalue.
The Office Copies obtained from the Land Registry revealed that there was more than one mortgage on the property. We had to find out if or not the registered proprietors were in negative equity and whether they would be able to discharge all mortgages over the property.
The Land Registry documentation revealed that the property was subject to restrictions/rights/covenants as set out in a transfer dated many years ago . It was important that we check with the registered proprietors conveyancing solicitor that these restrictions had been fully complied with.
The managing agent was Bramham Lodge Management Company Limited and Dawn Thomas was the property lawyer in charge of conveyancing in the area.
The estate agent's sales particulars, detailing the registered proprietors conveyancing solicitor, were obtained shortly before receiving the sale documentation.
