If you don’t have a will, then the probate court will distribute your assets based on statute.
The normal procedure is for the executor named in the will or the administrator appointed by the court when there is no will to be responsible for the distribution of the assets and for outstanding debts to be paid.
The executor is usually responsible for opening the probate case, providing an inventory of estate assets, collecting the descendent’s property, and paying any debts and any inheritance tax due.
