Title was registered at HM Land Registry, so Elaine was able to use their e-services portal to download a copy of the title and plan on-line straight away.   The title showed that the building was subject to some old restrictions, details of these were set out in the register so Elaine was able to send a comprehensive package to the other Solicitors straight away, and save time.

The vendors were asked to confirm that they had not carried out any works to the house, or done anything else which might be in breach of the old restrictions. They gave this confirmation, and the buyer’s Conveyancers were informed accordingly.

As the clients had an existing mortgage, Elaine also contacted their mortgage lender straight away to get a statement showing how much would have to be repaid when the sale was completed. Solicitors representing owners are required to arrange settlement of any existing mortgages when a sale completes. 

In order to do so they need to know the approximate amount outstanding before contracts are exchanged, in case there is negative equity situation.  Sometimes people think that they will have a small surplus on completion, but have overlooked that their lender will charge an early redemption penalty, and this will mean that they will have to repay more than the selling price.

Obtaining a redemption statement early in a sale enables Solicitors to provide clients with a guide to the amount of the surplus available after completion. This avoids any unpleasant surprises on completion.

There was no such problem on this sale, and Elaine was able to progress the sale to a speedy completion without difficulty.
