Fridaysmove -recommended Solicitor Serina Abay was instructed to handle the sale of a freehold mid-terrace home on Channel View Terrace in Plymouth, PL4. Draft contracts were exchanged on the 2nd of February 2010 between Serina and the purchaser’s Conveyancing Solicitor from the Premier Property Lawyers branch covering Plymouth.
The charges register in the official copies from the land registry revealed the following covenants:
1 A Conveyance of the land in this title dated 24 December 1898 contains the following covenants:-
"Subject to the restrictions and conditions hereinafter contained and imposed on the said Mrs J her heirs and assigns as obligations intended to be binding in perpetuity on the said plot of land hereby conveyed and all future owners thereof as far as the law will permit AND the said Mrs. J doth hereby for herself her heirs executors administrators and assigns covenant with the said Mr. R his heirs and assigns in manner following that is to say that she will not at any time hereafter erect upon the said plot of land hereby conveyed (hereinafter referred to as "the purchased premises") any building except the house and buildings now erected thereon or make any addition to such existing buildings or any alteration thereto either in the external design or elevation thereof or otherwise AND will at all times hereafter maintain all the division walls and railings to the height and of the nature and kind now existing thereon AND in particular will use the said piece or parcel of land and the house erected thereon as and for a private dwelling house only and not for the purpose of a tavern hotel beerhouse or otherwise for the sale of intoxicating liquors or as a shop or for the purpose of any trade or manufacture of any description. "
2 The land is subject to the following rights reserved by the Conveyance dated 24 December 1898 referred to above:-
"EXCEPT AND RESERVING unto the said Mr. R his heirs and assigns the right at any time hereafter to connect the drains and sewers in or under any other plots of land forming part of the said Building Estate with the sewers and drains which now are or may at any time hereafter be in or under the said plot or parcel of land hereby conveyed and the free and uninterrupted passage and running of water and soil at all times in and through such last mentioned sewers and drains. "
The property was located within the local authority district of Plymouth City Council at Armada Way, Plymouth, PL1 2AA.
The transaction was completed on the 10th of February 2010 which was well in advance to the anticipated completion date.
