When the leader of Fridaysmove ’s team Nottingham Conveyancing, Fayruz Cahill handled the Conveyancing on the sale of a freehold house in the Carlton district of Nottingham, NG4, she was able to get the sale completed just in time for the Christmas holidays.

The Christmas Conveyancing Rush

The sales particulars were received from the local branch of David James (the Nottingham based firm of agents who had negotiated the sale) not long before Christmas. In view of the customary long holiday period, both seller and buyer were anxious to complete beforehand. This is now, perhaps unsurprisingly, a common problem for Conveyancers - the majority of firms close for the whole of the holiday period, and it is difficult to arrange legal completion of property transfers during the shut-down. Once a sale has been arranged, people prefer to move before the break rather than delay for perhaps two weeks or more, so it is essential that Conveyancing Solicitors try to meet their client’s requirements, if at all possible.

Fayruz was able to swiftly complete the draft contract and send this with a copy of the Land Registry title to the buyer’s Conveyancing Solicitors in Nottingham, Messrs. John O'Connor of Gothic House, Barker Gate, Nottingham.

As there is often a rush to complete property transactions immediately before the start of the Christmas holiday period, Conveyancing Solicitors will be under considerable pressures when they have several transactions wanting to complete before the deadline. They will be dependent on the co-operation of the other agencies involved in the transaction, especially mortgage lenders. It is necessary to make arrangements to pay off any existing mortgage on a property being sold. Fortunately many lenders can now provide redemption statements at short notice, some even provide a facility for Solicitors to obtain the information online, while most will now fax the figures within a few hours. However not all lenders provide this level of service, and unfortunately some require a week of more notice.

Solicitors acting for purchasers will need to draw down mortgage funds, which they cannot do until they are able to give a certificate of title. Again many lenders can send the money at short notice, but some are less helpful.

Another problem in the past was the delays which built up in the post, but that is generally now a thing of the past, thanks to the use of email, fax and other electronic means of communication.

Fortunately, on this sale the buyers and their Nottingham Conveyancing Solicitors were very helpful, as were the mortgage lenders involved, so that a completion was achieved on 18 December, much to the satisfaction of everyone involved
