If the property for which you need a Conveyancing Solicitor does have a septic tank, you will need to register with the Environment Agency before 1 January 2012.
If your house is not connected to the public sewer system, then drainage will probably be to a septic tank or else a package sewage treatment plant (often called a 'package plant'). Under new regulations the owners of existing septic tanks or package plants will be required to register them with the Environment Agency by the end of 2011.
Many rural properties are drained to septic tanks, but they may also be found in urban areas where a house could not be physically connected to a main sewer at the time it was constructed.
How do I register?
Registration is free, with advice on registration and an online application form available on the Environment Agency's website.
As registration has not previously been needed, home owners may not appreciate the need to do so now. However when a house is sold the buyers Conveyancing Solicitor will require the following to be handed over:
- notice that the discharge has to continue to comply with the criteria for registration;
- a description of the system and any manuals you may have; and
- records / receipts of any servicing and desludging.
Septic tanks and package sewage treatment plants are often located on land owned by a neighbour, which is separate from the house that the sewage comes from. In such cases, the owner who has the right to use the septic tank should register. However, if a tank serves more than one property then any of the owners can apply for registration, although the one on whose land the tank is situated is the most suitable.
These new regulations require home owners whose properties drain into septic tanks to ensure that the sewage treatment system is operated and maintained in accordance with a plan as specified within the manufacturer’s instructions or other maintenance schedule adopted by the occupier and by competent persons. It is likely that such owners will already have made arrangements for regular inspection and emptying, so this should not impose too much of an additional burden on property owners.
