When someone is left with the job of applying for Probate, it can present itself as a rather daunting task, especially if they are not familiar with what happens during the Probate process.
If you are appointed as one of the Executors of a Will then it is usual practice for you and the Executors to put the wheels in motion and obtain the Grant of Probate.
All the Executors named in the Will must apply for Probate jointly. If one party does not wish to then they must sign a Deed of Renunciation renouncing their right to act as an Executor.
The Probate process involves several steps and can be undertaken personally or with the help of a solicitor or lawyer. The main steps are as follows:
Your solicitor will then apply for Grant of Probate
Once Probate has been obtained, your solicitor will start to deal with the assets, and finalise the Estate.
As an Executor who has the responsibility of dealing with the Estate, it is important to be aware that any Inheritance Tax on the Estate must be paid within 6 months of the date of death, failing which, interest will be payable. If land or property is involved, it is possible to pay IHT in annual instalments.
You can apply for Probate personally in which case it must be done directly at the Liverpool Probate Registry office. You will need to make an appointment with them in order to do this.
Fees for Probate will depend on the Solicitor in Liverpool you have instructed. Some firms will charge a percentage of the value of the Estate as their fee while others may charge an hourly rate which means you will be uncertain as to what the final legal costs will be. If the Estate is complicated then you should expect to be charged more since additional work will be involved, eg, where there are a vast number of assets, missing beneficiaries or where there are assets abroad.
