Conveyancing Solicitor Jaaine Intharajah was instructed to handle the purchase transaction for Mr. and Mrs. W in December 2009 for a home located on Drayton Road, Portsmouth, PO2.

The land registry documentation revealed that the property was subject to covenants as set out in a conveyance dated 21/06/1893; Jaaine checked with the seller’s Conveyancing Solicitor to verify that the aforementioned covenants had been fully complied with.

A Conveyance of the land in this title and other land dated 22 June 1893 made between (1) Charles Dye (2) Henry Snelgrove and (3) Adam Edward Lillie contains the following covenants: -

“And the said Adam Edward Lillie hereby covenants with the said Charles Dye that no part of the land hereby conveyed shall be used at any time hereafter as the site for a public house beer house or other licensed place for the sale of wines spirits or beer and that no building erected on the said land shall at any time hereafter be used as a public house beer house or other licensed place for the sale of wines spirits or beer”

Acting on behalf of the seller’s was Larcomes LLP at 168 London Road, North End, Portsmouth, Hampshire, PO2 9DN.

There was a concerning discrepancy between details of the vendors as per the legal papers as against the official copies.  It was important for Jaaine to clarify these details to be sure that the registered owner and the seller on the contract were one and the same.

The freehold dwelling is situated within the local authority district of Portsmouth City Council at the Civic Offices, Guildhall Square, Portsmouth PO12AL.

Sales documentation from Jeffries Estate Agents (Portsmouth Office, 112/114 London Road, Portsmouth, Hampshire, PO2 0LZ) with details from the seller’s Solicitor from Larcomes were received shortly before receiving the legal papers.

The transaction was completed in advance to the Christmas holiday season on December 11th, 2009 and Jaaine’s clients were happy to settle into their new home in time to celebrate.
