In September 2009 Fridaysmove Canary Wharf and Poplar residential conveyancing team acted on the purchase conveyancing for a 125 year leasehold for a property valued at around £280,000 in Arden Crescent, London, E14 (the local council being Tower Hamlet Council).

Additional enquiries were raised within the same day of receiving letter with draft contract papers including:

  • Standard Conditions of Sale
  • Official Copies,
  • Land Registry Documentation.

The Land Registry Office Copies supplied revealed that the sellers had owned the property for less than five years and, as such, there was a danger that the property transfer could be set aside if the property was a Transfer at Undervalue. The Land Registry documentation revealed that the property was subject to restrictions/rights/covenants as set out in a 1989 transfer. It was important that we check with the sellers conveyancing solicitor (which happened to be Fridaysmove as well) that the restrictions/covenants etc. had been fully complied with.

Catherine Williams was the property lawyer in charge of conveyancing in Canary Wharf and Poplar, Tower Hamlets, East London, London. The estate agent's memo of sale detailing the sellers conveyancing solicitor was obtained shortly before receiving the letter with draft contract papers. The estate agent was the Felicity J Lord branch covering Canary Wharf and Poplar.
