Conveyancing speeds through on Derby home despite title register restriction

In November 2009, Property Lawyer Jaaine Intharajah handled the Conveyancing in Derby for a freehold residential home located on Lancaster Walk, DE21 and valued at £168, 000.  

The home is in the local authority area of Derby City Council at 1 Albion Street, Derby, DE1 2PR.  

The land registry official copies revealed the following restrictions on title:

“Title absolute

1 (14. 02. 2000) PROPRIETOR: Mr. H and Mrs. H of Lancaster Walk, Pheasant Field, Spondon, Derby DE21 7LS.

2 (25. 04. 2005) RESTRICTION: No disposition of the registered estate by the proprietor of the registered estate is to be registered without a written consent signed by the proprietor for the time being of the Charge dated 30 March 2005 in favour of FirstPlus Financial Group PLC referred to in the Charges Register. ”

Jaaine had to ensure that the registered proprietors would be able to repay the lender in order to have the restriction removed prior to the transfer of the property.

The estate agent was the Hall and Benson branch covering Derby at Pinxton House, 75 Sitwell Street, Spondon, Derby, DE21 7FH.

The buyer's Conveyancing Solicitor was from Flint Bishop Solicitors at St Michael's Court, St Michael's Lane, Derby DE1 3HQ.

The transaction completed on the 24th of November 2011, much to the satisfaction of both parties.
