The official copies from the land registry revealed an extensive list of covenants from a transfer of the land, dated 14 November 1900, that were most likely imposed by the original developer of the estate, including the following:
- No erection except fences or a bay window or porch shall be made or put up on any ground set out as front garden and abutting on a front street.
- Each owner shall before commencing to build give notice in writing of his intention to the adjoining owner or owners but this shall not be a condition precedent to the right of a person who erects a party wall half on an adjoining plot in accordance with clause 9 to enforce payment for the outer half part of the said party wall to the extent provided by clause 9.
- No lime kiln, brick kiln or place for the manufacture of lime bricks, tiles or any other similar articles shall be permitted upon any part of the estate. Nor shall any knacker's yard, gut manufactory, tallow melting works, smelting house, iron foundry nor any noisome or offensive trade or business to be carried out on any part of the property. No slaughter house or braziery shall be permitted on plots 437 to 465 inclusive.
- When a house facing one street or road has a side boundary garden fence or wall facing another or side street or road such fence or wall shall not be more than 6 feet 6 inches in height and shall be carried (at no greater maximum height) along the back road at the rear of the plot on which such house is built to the building line of such other or side street or road. No erection of greater height than 6 feet 6 inches shall be allowed on the back or side garden facing such other or side street or road in front of the building line of the remainder of such other or side street or road.
The above restrictions did not trigger any significant concerns or questions from the buyers and Irene was able to progress with the transaction according to schedule. In many cases, however, a buyer might request that the seller pay for an indemnity insurance policy when it is not clear who has the benefit of a covenant and to protect against any breaches.
