THAT no noxious noisy or offensive trade manufacture business or calling should be carried on upon the said land and hereditaments thereby conveyed or any part thereof or in any building to be erected thereon AND ALSO that he the said George Smith would erect within three calendar months from the date thereof and at all times thereafter would repair and maintain a substantial stone or brick boundary wall not less than five feet in height from the surface of the ground along the whole of the Southwardly side of the land and hereditaments thereby conveyed as shown by the T mark on the said Estate Map but exclusive of the portion forming a moiety of Sackville Street aforesaid in front of the land and hereditaments thereby conveyed AND ALSO would pave with blue bricks the foot pavement in front of the land and hereditaments thereby conveyed within three calendar months from the completion of any dwelling house or dwelling houses that might be erected thereon AND ALSO would Pay his proportion according to the frontage of the expense of repairing maintaining and keeping in repair the street or road including the foot pavement in front of the land and hereditaments thereby conveyed until the repair and maintenance of the same should be undertaken by some competent authority AND ALSO that the road including the footway in front of the land and hereditaments thereby conveyed should for ever thereafter remain open and unbuilt upon and dedicated to the public AND ALSO that he the said George Smith would not erect upon the land and hereditaments thereby conveyed any buildings within twelve feet of the road in front thereof AND ALSO that no building to be erected on the said land and hereditaments should be used as an Inn Public House or Refreshment House or for the sale of beer wines or other spirituous liquors either under an indoor or outdoor licence or as a place of public amusement entertainment or resort.”
