Conveyancing in Surrey reveals application to convert a garage had previously been refused

The local search is a vital part of Conveyancing in Surrey for homebuyers.

One of the main reasons is that the search gives details of the planning history, which is particularly important for newer homes.

The information given by the local authority will include not only details of applications which have been approved, but also those which have been refused. This may be relevant if a buyer is considering an alteration or extension and finds that an application for similar development has already been turned down.

In August, Conveyancing Solicitor Serina Abay was handling the Conveyancing in Surrey for Mr and Mrs R, who were buying a freehold home on Quarry Bank, Lightwater, Surrey GU18 5PE. The local search with Surrey Heath Borough Council at Surrey Heath House, Knoll Road, Camberley, Surrey GU15 3HD revealed the following planning entries:

App no. 1985/0444
Land At Briar Avenue Lightwater Plots 1-32 Mcclean Homes SE Ltd Surrey

App No. 89/0716
Proposal: Erection of single storey side extension and conservatory.
Decision: GRANT subject to conditions 11/09/1989

App No. 88/1571
Proposal: Erection of garage and conversion of existing garage to habitable accommodation.
Decision: REFUSE subject to reason(s) 07/04/1989

It is not uncommon to find properties where an integral garage has been converted into a room. This is something which usually does not require permission, but on checking the conditions attached to the original consent for this estate Serina found that the council had removed permitted development rights with regard to garage conversions.

It appeared that a previous owner had applied for approval of such a conversion, but that had been turned down. Serina informed her clients of this, in case they were contemplating alterations in the future.

Reference to the sales brochure from agents Chancellors of 76 Guildford Road, Lightwater, Surrey GU18 5ST confirmed that no apart from the side extension no other alterations had been carried out.

Once copies of the various approvals and replies to other enquiries were received from Bishop Lloyd & Jackson of Westmead House, Westmead, Farnborough, Surrey GU14 7LP, the Property Lawyers undertaking the Conveyancing in Surrey for the sellers, a full report on the property title was sent to the buyers. Contracts were then exchanged and the purchase quickly completed.
