When an apartment is advertised as including allocated parking, this must be checked by the buyer's Property Lawyers to ensure that there is in fact a legal right to use the space.

In some cases Conveyancing Solicitors in Sheffield find that the original owner acquired the right to use a specific bay under a separate lease, which also has to be transferred to the buyer.

Conveyancing Solicitor Fayruz Cahill had to investigate this when acting for the sellers of a flat in Kingswood, Sheffield S6. Winkworth's office at 11, Lound Side, Chapeltown, Sheffield S35 2UQ had negotiated the sale. The sales brochure received from the agents showed that the the apartment was located in a much older building, apparently a Victorian hospital, which had been converted into residential properties.

There were many apartments in the building, so if parking in the grounds was only available on a first come, first served basis, there would be potential problems for the buyers. Fayruz checked the lease of the flat, and was pleased to see that it did indeed include the right for the owners to use a specific space marked on the plan. She asked her clients for confirmation from they had not had any difficulties with parking, as unauthorised use of allocated areas can also be a problem which could affect the sale, and liaised with the Sheffield Conveyancing Solicitors acting for the other side.
