September 2010 saw Croydon Conveyancing Solicitor Bipin Vaghela acting for Mr and Mrs D on their purchase of a freehold home on Whitefield Avenue, Croydon, CR8. Having received sales details from local agent Daniel Adams of 147 Brighton Road, Coulsdon, Croydon CR5 2NJ, Bipin contacted the Conveyancing Solicitors in Croydon acting for the sellers.

Following the abolition of home information packs earlier in the year, Bipin knew that he would have to carry out a local search as one would not be supplied by the sellers or their Conveyancing Solicitors in Croydon. He therefore submitted an online application to Croydon Council at Taberner House, Park Lane, Croydon, CR9 3JS, and received the replies within a few days.

The forms revealed the following information:

  • Whitefield Avenue was an adopted highway, i.e. it is a public road maintained by the council.
  • There were no plans to build any new roads or railways in the vicinity of the property.
  • No major roadworks were scheduled to take place nearby.
  • There had not been any planning applications since the house was built, nor were there any records of building regulation approvals.
  • The home was not in a conservation area, no trees on the property affected by preservation orders, nor were any proposed.
  • The council had not served a compulsory purchase order for the dwelling, nor were there any local land charges registered, e.g. improvement grants which the sellers would have to repay.

As there were no adverse entries Bipin was able to carry on with the purchase and contracts were exchanged as soon as the buyers received their mortgage offer.

Fortunately it is rare for Conveyancing Solicitors in Croydon to find anything shown in a search which would cause a buyer withdrawing altogether. However if information is received about previous planning permissions or other matters which may affect a purchaser’s use of the property then buyers' Property Lawyers will need to obtain further information and copies of any consents. Sellers can therefore save delays by ensuring that their Conveyancers have copies of any relevant documents as early as possible.
