It was a pleasure for Property Lawyer Dawn Thomas to act on behalf of the sellers of a modern flat in the centre of Birmingham in 2010.  The clients full understood the need for Dawn to ask them  to complete the lengthy information forms required on the sale of leasehold properties, which were required by the Conveyancing Solicitors in Birmingham acting for the buyers.

The flat was at King Edwards Wharf, 25 Sheepcote Street, Birmingham, West Midlands, B16 8AH which had been constructed about ten years previously. Information about the purchasers and their Conveyancing Solicitors in Birmingham was supplied by Maguire Jackson's branch on Liberty Place, Sheepcote Street, Birmingham B16 8JZ. As soon as Dawn received this she sent out the draft contract together with a copy of the lease and the forms which her clients had already completed.

The building in which the dwelling was situated was part of a larger development situated on an island close to the city centre. Surrounded by part of Birmingham's extensive canal network (locals will tell you the city has more waterways than Venice!) it enjoyed an attractive waterside aspect.

Conveyancing Solicitors in Birmingham often find that when carrying out the usual searches with Birmingham City Council at the Council House, Victoria Square, Birmingham, B1 1BB that they may have difficulty in identifying a property from its current address. The reason that this occurs with modern properties can be that the original planning application related to a large area, and referred to existing buildings and roads which may have since disappeared as part of the redevelopment.

Copies of planning consents available online

The Property Lawyers acting for the purchasers, Davisons Solicitors of Sycamore House, 54 Calthorpe Road, Edgbaston, Birmingham B15 1TH, contacted Dawn to say that they were having some difficulty in getting details of the correct planning consent for the building. After checking on  the local authority's web-site, Dawn was able to ascertain that the correct consents were

  • 1999/04215/PA  24-25 Sheepcote Street City B16 8AE Demolition of former workshops to rear in preparation for erection of new residential accommodation and related uses and conversion of frontage buildings to provide residential units and related accommodation Final Decision 15-09-1999 Approved subject to Conditions
  • 1999/04214/PA  24-25 Sheepcote Street City B16 8AE Conversion of listed frontage buildings to residential, concierge, office facility, coffee café/bar and erection of 100 residential units and associated accommodation, access road and parking provision.

Copies of these were obtained and sent to the buyers' Conveyancing Solicitors in Birmingham to enable them to check that everything was in order. Dawn also obtained a copy of the completion certificate confirming that the council had signed off the unit for building regulation purposes.

Once the other Conveyancers had all the information they needed and were satisfied with the result of their enquiries they quickly arranged completion. The sellers thanked Dawn for her work in ensuring that their sale was completed with no problems as far as they were concerned, although they appreciated that she had had to deal with numerous enquiries.
