The local land charge search for the property revealed the following planning permissions and building regulation approvals that had previously been granted:

It was also noted that any planning applications relating to land adjoining the curtilage of the property did not fall within the scope of this report, so if that information was needed by the purchasers, additional enquiries would have to be made.

Bethany checked that there were no breaches of any permissions or approvals that, if not verified, could leave the new owners open to enforcement action in the future.

Since the permissions were dated prior to 2003, breach of planning permission was no longer enforceable by the council so there was no cause for concern. On the contrary, if the permissions had been dated within the last four years, then the terms of them would still enforceable by the council if a breach has taken place.

This time period does not, however, apply in relation to building regulation approvals and completion certificates and your Conveyancing Solicitor should always ask for and obtain copies of the building regulation approvals and completion certificates (if granted by council at specified time).

Breaches of building regulations can be enforced via an injunction under Section 36(6) of the Building Act 1984 giving the council the authority to take action at any time for any works undertaken since 1985.
