In July 2010, Fridaysmove -approved Solicitor Amanda Gandham took instruction on the Conveyancing for the sale of a freehold property located at West Avenue, Benton, Newcastle-upon-Tyne, NE12.

The property information questionnaire completed by the sellers on April 28th, 2010 indicated that damp proofing had been carried out to the ground floor bathroom and front wall, as well as the addition of a 2m square conservatory to the rear of the house. It was not necessary for Amanda to provide any additional documentation to the purchaser’s Conveyancing Solicitor in regards to permissions or building regulation guidelines for the works carried out as approval was not needed.

When acting on behalf of the buyer, Conveyancing Solicitors should ensure that relevant documentation, if applicable, is obtained to verify that any works that were carried out to the property and surrounding area are in compliance with planning regulations. 

The land registry documentation revealed a series of restrictive covenants that were originally imposed by the developer of the estate in a Conveyance dated 15 August 1896, including the following:

  • Roof: The roofs shall be covered with blue Welsh Countess slates of a uniform colour and finished with a ridge stone the chimney stacks shall be finished as shown by the elevation stone steps. The front doors shall have stone steps neatly worked and polished.
  • Gardens: Each house having garden ground shall be set back as shown in the plan and the space between footpaths and the houses and the ends of houses shall be used as gardens only (no erection of any description shall be permitted thereon) and shall be enclosed with a neat cast iron palisade of a pattern to be approved by the Architect and set on a stone coping fourteen inches by ten inches canted.
  • Restrictions: The outbuildings in yard shall not be carried up higher than sills of first floor windows of same house No part of the sites or erections shall be used for the purpose of a beer or public house shop or for any trade manufactory or business whatsoever without the consent in writing of the Company their successors or assigns and in the case of a breach of this condition the purchaser her heirs or assigns shall pay to the Company their successors and assigns the sum of twenty pounds for the first three months and ten pounds for every succeeding month during which such breach shall take place such sums to be sued for and paid as liquidated damages.

It is unlikely that restrictive covenants that were imposed over 100 years ago are still enforceable, however your Conveyancing Solicitor should ensure that indemnity insurance is obtained if there is a chance that the covenants can be enforceable in the future to protect the home owner.
