In 2010 our Conveyancing Solicitor Fayruz Cahill acted for buyers of a semi-detached house in Houghton le Spring, Sunderland, Tyne & Wear, DH5. The sale had been negotiated by the local branch of north-east agents Pattinsons of 14a Newbottle Street, Houghton Le Spring, Tyne and Wear DH4 4AB.
Draft contract and other papers were emailed to Fayruz by the sellers’ Conveyancing Solicitors, Riley Langdon Solicitors. This enabled Fayruz to check them through and put the local searches in hand straight away.
The registered title was freehold, but it appeared from the draft contract that the property was being sold by the executor of a deceased owner. Fayruz asked the seller’s Conveyancer to supply a certified copy of the grant of probate which would be required by the land registry as evidence that the seller was entitled to transfer the house on behalf of the deceased.
Executors will usually be unable to provide detailed property information, as they probably have not lived at the property. It is also common to find that a house has been unoccupied for some time, while the Solicitors are obtaining Probate. Buyers should therefore be careful when buying from executors that they have a proper survey carried out, and the services fully checked by qualified engineers, before committing to the purchase.
Once the purchasers had received their mortgage offer, Fayruz was able to arrange exchange of contracts and the purchase was rapidly completed to their satisfaction.
