The official copies from the land registry office responsible for Cardiff revealed a schedule of covenants and restrictions affecting the property, as set out in a Conveyance dated 7 November 1996.   Joanne had to interpret the said covenants and bring them to the attention of her client as they dictate what can and cannot be done at the dwelling by the owners.

The following are details of some of the restrictions contained in the document:

  • The right for the husbands and their successors in title and all persons expressly or by implication authorised by them to enter upon such part of the property as may be necessary and upon reasonable prior notice (except in the case of emergency) in order to inspect, maintain, repair, renew, alter or carry out any other works to the pipes, wires, cables, conduits or other conducting media laid or to be laid within 80 years of the date hereof doing as little damage as practicable and making good any damage so caused to the reasonably satisfaction of Cofton and their successors in title, the owners or occupiers for the time being of the property.
  • Full right and liberty after the date hereof to erect new buildings of any height on the commercial and community land and in such manner as the husbands shall think fit notwithstanding that the same may obstruct, affect or interfere with the amenity of or access to the property or the passage of light and air to the property.
  • Without prejudice and without limitation to the generality of the foregoing a right to connect into and to the free and uninterrupted passage and running of foul and surface water sewage and other services from and to the commercial and community land in and through the pipes, wires, cables, conduits, conducting media now or within 80 years of the date hereof constructed upon the property.
