Fridaysmove ’s Conveyancing in Buckingham Solicitors, through local knowledge and previous experience, have identified that there are over 2900 listed buildings in Buckingham and this can often interfere with plans for works or renovations that you might wish  to carry out on your property. A breach of a planning control can not only result in fines and pull down orders, but also prison sentences. This is regarded as a serious offence; however, your Conveyancing Solicitor will ensure that listings affecting your home are thoroughly examined and have been complied with.

As a buyer, it is crucial that your Conveyancing Solicitor obtain copies of any listings to ensure that all previous works at the property complied with the listed building requirements and planning permissions, as retrospective permission is not granted by the council. Elaine Fannon, Fridaysmove ’s Conveyancing Solicitor, did this on behalf of Ms. B who purchased a property on Church Street, Buckingham, Buckinghamshire, MK18 in July 2010, as this property was noted as a listed building.

The local authority for the home is Aylesbury Vale district council.

A local resident was pursued through the courts by the council for more than 18 months since building the addition to his home, located less than 10 miles from the home purchased by Elaine’s client, without planning permission. The man was given a three-month suspended prison sentence for contempt of court and ordered to pay costs of £6,386. If the home owner fails to pull down the two-storey extension, he will be jailed. The council had already gained a court injunction ordering that the addition to the home be pulled down, which led to his conviction for contempt of court. He had also previously been fined £5,000 and ordered to pay court costs in excess of £20,000 for ignoring orders to demolish the extension.

Elaine’s thorough Conveyancing on behalf of Ms. A, in conjunction with the seller’s Conveyancing Solicitor’s report, led to the successful closing of the sale. The seller’s Conveyancing Solicitor was City Law Limited at 5A Copperhouse Court, Buckinghamshire MK7 8NL. The estate agent was the Ella Homes branch at Bourton Road, Buckingham MK18 7DS.
