The local authority search revealed that Colebeck Mews was an unadopted road in this area. This was of concern to the buyer and their mortgage lender. Further investigations need to be made and with the vendors as to ownership of the road and practical arrangements in terms of maintenance and upkeep. Unadopted or private roads do not belong to any Local Authority and they have no duty to maintain them.  However, they may be rights of way - and/or highways for specific classes of vehicle.

Planning permissions were revealed on the property and investigated by our conveyancing in Barnsbury and Canonbury planning department. The Land Registry Office Copies supplied to us were out of date and accordingly fresh copies were requested from the vendors conveyancing solicitor.

The Land Registry documentation revealed that the property was subject to restrictions/rights/covenants as set out in a transfer dated 27/02/1995. It was important that we check with the vendors licensed conveyancer that the aforementioned restrictions/covenants etc. had been fully complied with.

The estate agent's memorandum of sale detailing the vendors licensed conveyancer was obtained shortly before receiving the legal papers.

This document outlines the sale/purchase property, the price, the Purchaser and the Seller’s details and details of their respective conveyancing teams. It is worth noting that a Sales Memorandum  does nothing more than record the agreement reached between the parties subject to contract and forms no part of a contract for the sale of the said property between the parties
