Fridaysmove were instructed by Mr and Mrs O  to act on the purchase of a House in  Trowbridge.

Jane Lim, the lawyer in charge of Conveyancing in Trowbridge, proceeded with the due diligence on the Wiltshire home and as it transpired, the family were relieved at the level of investigation.

The freehold property in Hilperton, Trowbridge, purchased for £218,000, was affected by a number of planning permissions.

Conveyancing enquiries, issued on the day of receipt of the purchase agreement (encompassing ancillary conveyancing information) were forwarded to the seller's Solicitor - Forrester and Forrester in Malmesbury, Wiltshire.

Working closely with the estate agent, Kavanaghs, and the West Wiltshire Council, Jane's attention to detail uncovered various permissions and agreements warranting deeper investigation.

Specifically:

  • Town & Country Planning Act 1990 - Section 106 Supplemental Agreement Dated 23/05/1997 Between The Developer, Wiltshire County Council (responsible for Trowbridge) and the Charges Relating To Highway Works registered 23/05/1997 .
  • Permission for plot developments including revised house types and a reduction in plots from 25 to 23.
  • A conservatory application to the rear of the Trowbridge house.
  • A plan for a further 80 dwellings nearby to include highway works
    registered 23/05/1997
  • A Town & Country Planning (control of advertisements) regulations 1992
West Wiltshire district council area of special control order 1993
dated 16/09/1993 that included the home in the area of special control.
  • A section 106 variation agreement dated 18/04/1997 relating to highway works between gallagher estates limited, the wiltshire county council and Mr & Mrs R.M. Fyfe.
  • A further Section 106 supplemental agreement relating to the provision of a primary school between heron land developments, the County Council and Gallagher Estates.

Jane's familiarity with Conveyancing in the Trowbridge area meant she was quickly able to satisfy any concerns the purchaser raised and was able to advise on suitable courses of action including the purchase of indemnity insurance to protect the asset of the Trowbridge couple.

It is critical when selecting a Conveyancing Solicitor to ensure local knowledge as this Trowbridge Conveyancing case demonstrated.
