Fridaysmove Conveyancing Solicitor, Sukhi Hayre encountered few problems when acting for the buyers of a freehold bungalow in Chippenham, Wiltshire in 2010. Once the property details were received from the sellers' agents, Blount & Maslin, who cover the Chippenham area from their local office, Sukhi initiated local searches and enquiries with Wiltshire Council.
The Conveyancing Solicitors representing the vendors were local Chippenham firm Forrester and Forrester of 61 St Mary Street, Chippenham, Wiltshire SN15 3JH. As soon as they forwarded the draft contract and copy title entries, Sukhi went through the papers and replied with some additional enquiries and draft Transfer deed for approval.
It is one of the main duties of a Conveyancing Solicitor acting for a house buyer to check that the terms of the contract proposed by the sellers' Solicitors are correct and do not contain any unacceptable provisions and to check that the seller has a good legal title to the property. The Solicitor will also look through any information forms supplied by the sellers, and raise further enquiries on matters where details are missing or further information is required. This work must be done thoroughly and any enquiries must be raised as soon as possible so that the transaction is not delayed.
When looking at the sellers' land registry title, Sukhi noticed that they had apparently owned the property for less than five years. If property is sold or transferred for less than full market value, for example by way of gift from a relative, this can have implications for subsequent buyers should the original owner become bankrupt. However the land registry now generally records property prices in their registers, so it is usually easy to see of the price paid by the vendor appears to have been market price at the time.
Sukhi was satisfied in this case that there was no problem and the sellers' title was in good order.
The title included details of some covenants dating from the time when the property was first built in 1970. Such covenants are often registered against houses, and in this case they were the typical covenants that developers impose, and are intended to ensure the look of the area. The sellers confirmed that they had complied with the covenants, and were not aware of any breaches, so Sukhi was able to advise her clients accordingly.
The buyers were then able to proceed with the purchase and contracts were exchanged. Sukhi was also dealing with the sale of the clients existing house, so she had to make sure that contracts for both sale and purchase were exchanged at the same time. This requires co-operation with the other Conveyancing Solicitors involved in the linked transactions, and everyone has to agree a final completion date. This was all arranged to the clients satisfaction, and they thanked Sukhi for her work.
