My solicitor is not on my Lender's panel - what do I do?

Many lenders, and particularly nationwide banks, were once willing to instruct any solicitors who requested to be added to their panel. More recently, lenders have begun to remove firms which have either not completed many conveyancing transactions or have failed to meet other criteria. To proceed where your Wiltshire lawyer is not on a mortgage lender' s panel, you have the following options:

  • Instruct another firm who is on your lender's panel, or,
  • Find a mortgage from a different lender

You could also choose to work with your current solicitor, but you will have to pay the lender's costs in addition to your own, as they will instruct a member of their panel. Consider these issues if you are intending to stay with your solicitor rather than opt for your mortgage lender's choice:

  • You will have to pay your lender's legal costs
  • By being required to send documents to the lender's solicitors, delays will inevitably occur
  • You will be unable to contact the lender's firm directly, as they will be acting for the lender rather than you

Does your Wiltshire purchase qualify for Stamp Duty Relief?

Stamp duty relief may be available in nearly 2,000 'disadvantaged areas' nationwide. In England and Wales, they are based on local government wards and electoral divisions. Wiltshire residential property under £150,000 within one of these areas is exempt from stamp duty. Normal rates of stamp duty apply for purchases greater than £150k. A postcode search is worth undertaking to determine whether a residence under the £150k threshold is in a Disadvantaged area.
