Weymouth Stamp Duty Relief

Disadvantaged areas relief may be available for property bought in around 2,000 locations across the country. Areas designated are identified by local government ward or electoral divisions. Residential purchases under £150,000 may be eligible for stamp duty relief. Note that normal rates of duty apply sales above £150,000. That said, for any purchase below £150,000, it is worth making a simple postcode search to find out if a property is in a Disadvantaged area. However this is not always accurate, and may not work for recently built properties.

Weymouth Listed Buildings

Special planning consent must be obtained for alterations, extensions or demolition of a listed building. Buildings are listed as either Grade I, Grade II* or Grade II, with the system and categorisation being administered by English Heritage. Anyone selling a listed property should ensure that their conveyancing solicitor has copies of all relevant planning consents, as well as any other associated documents and copies of plans which may be required by a buyer. Maintenance of listed buildings may require more costly materials.

Weymouth Tree Preservation Orders

When land around Weymouth is developed for housing, the existence of a TPO will be revealed in a local search against property on the original estate, whether or not there are any affected trees on the specific property being purchased. Local council consent for alterations to a TPO-protected tree should be confirmed before work commences. Conditions placed on Weymouth developers requiring them to plant trees during construction do not necessarily imply a TPO is in place. Obtaining a copy of any TPOs affecting a Weymouth home before it is marketed will make it easier for copies to be sent to a buyer's Conveyancing Solicitor with the draft contract.

My solicitor is not on my Lender's panel - what do I do?

Lenders once permitted any solicitors' firm to join their panel. These panels were established so that firms could join and thereby perform legal work on mortgages on behalf of lenders. Recently, lenders have changed the criteria for the firms which they will accept on their panels. They have also reduced the size of their panels, removing firms which do not carry out much Conveyancing work or which they consider to have proved unsatisfactory in the past. If your conveyancing solicitor is not on your preferred lender's panel, then the lender will not instruct that firm to act in connection with the mortgage. You then have a choice:

  • Obtain a mortgage from a less restrictive lender
  • Instruct a solicitor whom your lender accepts
  • Pay the lenders costs for their solicitor in addition to your own

It is usually cheaper to have the same firm act both for you and your lender, and carry out all the conveyancing work in connection with a purchase and the mortgage. Consider these issues if you are intending to stay with your solicitor rather than opt for your mortgage lender's choice:

  • You will have to pay your lender's legal costs
  • By being required to send documents to the lender's solicitors, delays will inevitably occur
  • You will be unable to contact the lender's firm directly, as they will be acting for the lender rather than you
