Concerns range from minor risks to potentially deadly issues such as radon gas exposure. As an Environmental Search is a review of data and records held by various sources, it does not cover unknown contaminants or environmental risks. Severely contaminated land should be investigated by the local council, although their records are not comprehensive. This is one of the reasons why a specialist environmental search is warranted. In some cases, you may also be able to review the full technical report used to prepare the search.
In South West England, there a large amount of conservation areas. There are 14 areas of conservation in Gloucestershire alone, including Barton Street, The Docks and Hempsted. In Cornwall, there are a staggering 145 conservation areas, as Cornwall is a very beautiful and scenic county.
Your Conveyancing Solicitor must check with the local authority before you attempt to make any alterations to a building within a conservation area, even if the building is not listed. If you have any specific enquiries, you must contact your local council.
In cases where houses have been built on land subject to an existing tree preservation order (TPO), it will be necessary to obtain a copy of this TPO from the council to check the plan. This is necessary to confirm whether this existing TPO directly affects the newer property. In order to approve consent, the local authority may request that replacement trees be planted. Trees planted in accordance with a condition placed on new build property developers are not necessarily subject to a TPO.
