Is your Lancashire new home purchase designated as in an at risk conservation area?

Conservation areas are designated by Local Authorities to oversee change in residential (and industrial) areas that people wish to preserve the character of. Unfortunately however, many are being neglected e.g. out of control street clutter.

The following conservation areas are reported as at risk:

  • Ruff Lane - poor, low vulnerability and deteriorating.
  • Scarisbrick Park - very bad, low vulnerability and improving.
  • Leyland Cross - fair, medium vulnerability and deteriorating.

What are the consequences if your solicitor is not on your lender's panel?

Mortgage lenders maintain panels of solicitors who they will instruct to carry out legal work on mortgages. At one time, many lenders, especially the large banks, were prepared to instruct any firm of solicitors who asked to be placed on their panel. Lenders have also reduced the size of their panels, setting more restrictive criteria for membership. If your lender does not accept your chosen solicitor, you must make a decision as to how to proceed:

  • Instruct another firm who is on your lender's panel, or,
  • Find a mortgage from a different lender

You could also choose to work with your current solicitor, but you will have to pay the lender's costs in addition to your own, as they will instruct a member of their panel.

Mining Searches

Underground workings have largely ceased, but a few mines are still operating. Although subsidence following the collapse of old workings will generally have already taken place, further ground movement may still occur. Official searches provide insurance cover for a house, protecting against a loss of value up to fifty thousand pounds. Coal is now often worked by the opencast method. This involves removal of soil and 'overburden' above the coal, which is then removed with heavy excavators. Environmental pollution is also often associated with old mine-workings, either from discarded waste or spoil, or as by-products if ore was smelted locally. Should a search reveal former mining activity in close proximity then a further survey may be required. Workings associated with other minerals mined in various, more isolated parts of the UK, also lack a central registry or easy database. As these areas are less residential however, there is less risk of such a mine impacting a Lancashire house.

There are approximately 238 areas in Lancashire where a mining search is required. These include; Stanhill, Farleton, Love Clough, Waterfoot, Robin Hood, Sabden and Eccleston.
