Liability for the repair costs of the chancel, or space around the altar, of a church may exist for owners of nearby homes. For many years it was felt that chancel liability was unenforceable. However, a recent judgement in favour of the church seeking chancel repair costs, (Aston Cantlow (PCC) v Wallbank  UKHL 37), reversed this assumption.

In cases where houses have been built on land subject to an existing tree preservation order (TPO), it will be necessary to obtain a copy of this TPO from the council to check the plan.
