The consequences of your solicitor not being on your Mortgage Lender's panel

Mortgage lenders maintain panels of solicitors who they will instruct to carry out legal work on mortgages. At one time, many lenders, especially the large banks, were prepared to instruct any firm of solicitors who asked to be placed on their panel. More recently, lenders have begun to remove firms which have either not completed many conveyancing transactions or have failed to meet other criteria. If your Gwynedd conveyancing solicitor is not on your preferred lender's panel, then the lender will not instruct that firm to act in connection with the mortgage. You then have a choice; you can either select a different lender or solicitor. It is possible to continue with your original choices, but your lender will expect you to pay for the legal costs relating to the mortgage. Bear in mind that it is usually more efficient and less expensive for the same firm act for you and your lender. If you decide to instruct another firm because they are on your lender's panel, you should bear in mind the following:

  • The new firm might charge more or may charge additional fees.
  • You might still have to pay your old firm for work they have already completed.
  • The new firm may have no knowledge of the Gwynedd area.

How much council tax will I pay?

During their enquiries, the buyers solicitor will request that the conveyancer acting for the seller confirms the council tax banding of the property. Council Tax rates for Gwynedd are set by Gwynedd Council. The bandings for 2012/13 are* -

  • Band A - £851.69
  • Band B - £993.64
  • Band C - £1135.59
  • Band D - £1277.54
  • Band E - £1561.44
  • Band F - £1845.34
  • Band G - £2129.23
  • Band H - £2555.08

Liability for Chancel Repair in Gwynedd

This is the liability of a property owner to contribute to the cost of repair of the chancel of a church. The potential for chancel repair liabilities has been passed down to successive owners of properties in Gwynedd which were once part of rectorial land. It is important to note that proximity to a church may be an indicator of chancel liability, but there is no distance that guarantees safety within a parish.

Is Chancel liability likely to change?

From October 2013, chancel repair liability will only bind buyers of registered land if it is referred to on the land register. By 2013, virtually all freehold land in England and Wales will be registered. Insurance is readily available for most properties.

After several acts of legislation passed last century, house purchases in Wales are much less likely to require a chancel liability search.
