Will you need a Mining Search

Mining - of coal, metal ores and other minerals - has been carried out across the country since the copper age of prehistory. Residential property may be affected by old underground workings, especially if there is still a risk of subsidence, but when mines have closed, there is often little evidence of former mining activity. Buyers can be surprised when their solicitor carries out such a search. Law Society recommends such searches are carried out for properties in any of the areas listed in the Coal Authority's directory. Coal is now often worked by the opencast method. This involves removal of soil and 'overburden' above the coal, which is then removed with heavy excavators. Large-scale opencast workings can impact on nearby property during operation, but the long-term consequences and impact on the environment may be generally less. Unfortunately, due to the industry's extremely long history, and the fact that there has never been any central mining authority, there is no single source of information about the location of mines. This means that searches are less straightforward than a buyer may anticipate.

There are approximately 285 areas in Derbyshire where a mining search is required. These include; Whaley Thorns, Harlesthorpe, Stanton, Peasehill, Unthank, Barlow and Wingerworth.

What are the consequences if your solicitor is not on your Lender's panel?

Lenders once permitted any solicitors' firm to join their panel. These panels were established so that firms could join and thereby perform legal work on mortgages on behalf of lenders. Increasingly however, lenders have lowered the number of firms which they will accept and allow to perform this work. If your lender does not accept your chosen solicitor, you must make a decision as to how to proceed; you can either select a different lender or solicitor. It is possible to continue with your original choices, but your lender will expect you to pay for the legal costs relating to the mortgage. Bear in mind that it is usually more efficient and less expensive for the same firm act for you and your lender.

The impact of HS2 on Derbyshire property

The Government is planning on building a high speed rail link between London and Scotland called High Speed 2 (HS2). The first phase is between London and the West Midlands and could be up and running by 2026. However, construction works are due to begin as soon 2017. It will pass through 22 local authority areas, and many people are understandably concerned about its potential impact on both property values and the local landscape. A search by your property lawyer will indicate if a Derbyshire residence is within two hundred metres of the planned route. The exact distance between a residence and the proposed route will be difficult to ascertain reliably, as will be the impact on nearby property.

Is a detailed HS2 Search worth it?

Construction work, traffic, noise pollution and vibration are all factors which could affect homes further than two hundred metres from HS2, but a local authority will not reveal this. Lasting for at least 8 years, works may cause severe disruption local Derbyshire residents. A more exacting search is available called a HIGHSPEED 2 search, which includes clear mapping to the nearest point of the proposed route (within a 1,000 metre radius of your proposed purchase and answers a number of questions). My home is closer than 200m to HS2 - should I worry?

Properties further than 200m away from the line, and therefore not covered by the relevant local authority search, will nevertheless be affected. The more detailed HS2 search will also provide you with more information. Certainly if the search suggests that your new home will be affected, you should bear in mind that once construction starts and the London to Birmingham HS2 Rail link becomes operational, current compensation legislation for noise and other blight factors (particularly any impact on the enjoyment of a view) can be a very drawn out and often unsatisfactory process. Measures will include schemes to streamline statutory purchase and sale and rent back procedures, and to accelerate small claims arising from for construction damage.
