Issues to consider when your lawyer is not on your Lender's panel

Panels of solicitors are maintained by mortgage lenders in order to undertake legal work on mortgaged properties. Recently, lenders have changed the criteria for the firms which they will accept on their panels. They have also reduced the size of their panels, removing firms which do not carry out much Conveyancing work or which they consider to have proved unsatisfactory in the past. These options are available to any homebuyer whose solicitor is not on their lender's panel:

  • Obtain a mortgage from a less restrictive lender
  • Instruct a solicitor whom your lender accepts
  • Pay the lenders costs for their solicitor in addition to your own

It is usually cheaper to have the same firm act both for you and your lender, and carry out all the conveyancing work in connection with a purchase and the mortgage.

Are you eligible for Cornwall stamp duty relief?

Disadvantaged areas relief may be available for property bought in around 2,000 locations across the country. In England and Wales, they are based on local government wards and electoral divisions. Because designated regions for relief are defined according to electoral wards, a postcode search is no guarantee a property will be eligible. If an online search cannot determine whether a Cornwall home is located in a disadvantaged area, clarification should be sought from the local council. For a purchase below the threshold, it is worth making a simple postcode search to find out if a property is in a disadvantaged area. This relief is not generally available on commercial property, but some relief may be available for 'mixed use' premises such as a shop with a flat above.
