Are you buying or selling a home in Birmingham?

"Birmingham is the UK's second largest city with a population nearing 4m people. Boasting more canals than Venice (35 v's 26 miles!) it's a large and diverse city. There is massive diversity in accommodation - from well appointed areas like Solihull to up and coming regeneration areas such as Aston.

However, whether buying a mansion or a flat, all conveyancing transactions can be held up by common issues like the speed of local councils and other Solicitors. In fact a staggering 40% of transactions fail to complete after offer - often due to the slow pace of the average Birmingham Conveyancing Solicitor. Legal Manager SignatureFridaysmove's combine a proactive approach, state of the art technology and a wealth of local experience to push your move through as quickly as possible.

Our offices are in Quayside Tower, Birmingham, Broad St, and we've recently helped movers with conveyancing in B1 to B98. We'd love to help with the legal side of your move - so why not get an online Conveyancing quote or call us on 033 0660 0286."

Some of the local issues encountered by Birmingham Conveyancing Solicitors when helping clients move:

Were you a client of Wolstenholmes?

Fridaysmove , together with other Birmingham Conveyancing Solicitors, have come to the rescue of several Birmingham city clients who were affected by the closure of a bulk conveyancing firm in the city.

On December 23rd 2009, Wolstenholmes Solicitors, based in Birmingham’s Victoria House, was shut down by the Solicitors Regulation Authority after allegations of dishonesty with clients’ money.Former conveyancing customers alleged that, after paying deposits to the firm, their calls had gone unanswered. To date, the Fridaysmove Birmingham Conveyancing team have spoken to over 200 former clients of Wolstenholmes.

The Solicitors Regulation Authority, Ipsley Court, Berrington Close, Redditch, B98, was prompted to take action after Wolstenholmes (established in 1818) left many home buyers and sellers out in the cold. Following the closure of Wolstenholmes by the SRA, a host of clients who exchanged contracts were unable to complete on the sale or purchase of their home.

The Law Society of England and Wales and Birmingham Law Society have joined forces to assemble a pool of Birmingham-based law firms who will be available to take on the work and complete the transactions without delay or inconvenience to former clients.

While an investigation into the firm is under way, the Law Society along with the Birmingham Law Society, and its counterpart in Manchester, has implemented a scheme to enable clients of Wolstenholmes to transfer their business to other solicitors.

The SRA have advised clients affected by the closure of Wolstenholmes that any money that they have entrusted to the firm is secure. These funds will be returned to them, either through the firm’s own professional indemnity insurance, or, if appropriate, the compensation fund administered by the SRA."

Does your Birmingham purchase qualify for Stamp Duty Relief?

Disadvantaged Areas Relief may be available in nearly 2,000 areas throughout the UK, using local government wards to delineate boundaries. Birmingham residential property under £150,000 within one of these areas is exempt from stamp duty. Above this designated limit of £150k, the normal rates of duty apply, and no further relief may be available. A postcode search will usually determine whether a home being sold for less than the threshold is eligible. 'Mixed use' property, including a shop with an apartment above, may also receive stamp duty relief.

Disadvantaged areas in Birmingham include Aston, Ladywood, Nechells, Sparkbrook, Billesley, Soho, Soho and Victoria, West Bromwich Central, Kingstanding, Stockland Green, Bartley Green, Weoley, Longbridge, Shard End, Hodge Hill, Chelmsley Wood, Washwood Heath.

Transportation Concerns in Birmingham

Significant highway works, or the expansion of the UK's rail system, can cause a great deal of inconvenience to unlucky homeowners living near construction. Buyers should be aware of any schemes (underway, or planned) in the Birmingham area. Birmingham searches show development nearby (closer than 200m) of roads and railway lines. Note that a scheme may be under active consideration by Birmingham council staff, but until formal proposals are published it will not be revealed in the search.

Birmingham Listed Buildings

Confirmation of a the status of a listed building will be discovered by a buyer's Conveyancing Solicitor, as part of the local search. The majority of listed buildings are Grade II, which includes many residential properties. A purchaser's conveyancing solicitor will make enquiries about any works which the seller or any previous owner has carried out since the property was listed. Owners of flats or apartments in a listed building should bear in mind that the building maintenance costs of such properties may be higher than for purpose-built blocks.

Owners and occupiers of scheduled monuments in Birmingham are subject to similar restrictions. Listed buildings and monuments in the local area include Bowl Barrow at King's Standing, Coleshill Bridge, Furnace End Bridge, and Kent's Moat.
