Property Conveyancing in Basildon carried out by Conveyancers may relate to homes built for the Basildon Development Corporation. The registered titles to such properties may contain a note to the effect that the land was vested in the corporation by a general vesting declaration executed pursuant to the provisions of the Town and Country Planning Act 1968. They should confirm that no documents of the earlier title have been produced to the Land Registry.
The land is accordingly subject to such restrictive covenants and easements as may have been imposed thereon prior to the date of the vesting declaration and are still subsisting and enforceable. These vesting declarations were made as a simpler way of transferring title to the corporation, and in practice Property Lawyers do not make further enquiries about the existence of any previous covenants or easements as it is assumed that none now exist.
Most properties in the area have now been registered at the Land Registry. Property titles include details of rights and covenants affecting a house, and the title also includes a plan showing the extent of the registered area. Title to flats and other similar properties will show which floor of a building the flat is located on and also include any garden or other area included in the lease.
It is not uncommon to find when carrying out Conveyancing in Basildon that the property being sold, whether freehold or leasehold, includes a separate garage or parking space, usually in a communal block or parking area. When this is the case the buyer’s Property Lawyer will check that the title includes all necessary rights of access. If the road leading to the parking area is not itself an adopted public highway then it will be necessary to ensure that there is a legal right over any such road, and that there are suitable maintenance provisions in the deeds. Buyers should check that any separate parking space is suitably defined or marked on the ground, and that there are no problems with other property-owners using the allocated space.
